Kraken settled with the SEC in February 2023 for $30 million in disgorgement, prejudgment interest, and civil penalties over its US crypto staking-as-a-service program, alleged to be an unregistered securities offering, and shut down US staking without admitting or denying the allegations. The SEC filed a lawsuit in November 2023 charging Kraken as an unregistered securities exchange, broker, dealer, and clearing agency; that lawsuit was dismissed in March 2025 without additional penalties or an admission of wrongdoing. In November 2022, Payward settled with OFAC for $362,158.70 over 826 alleged sanctions violations involving approximately $1,680,577 in transactions processed for users apparently located in Iran; the matter was classified as non-egregious and voluntarily self-disclosed.
